Ratko Mladic’s wife Bosiljka and son Darko have sued the state of Serbia over foreign currency seizure, daily Vecernje Novosti writes.
According to the daily, the daughter-in-law of the wartime military leader of the Bosnian Serbs is also suing the state for being fired from Telekom Srbija.
The wife and son of Mladic, who is wanted by the Hague Tribunal for genocide and other war crimes charges, have decided to sue the state because, they say, the War Crimes Prosecution and police unlawfully seized EUR 14,540 when they searched their home on February 22, 2010.
Their lawyer, Milos Saljic, who filed the suit, argues that there was no basis whatsoever to seize the money.
“They seized EUR 1,904 from Bosa and EUR 12,600 from Darko. This is why we are suing the state, requesting the return of unlawfully seized things. Police and the prosecution did not have any legal basis to do this. No proceeding has been launched against the two of them based on which they could seize the money. The state was supposed to prove that the money was used to finance his hiding, which definitely is not true here,“ he stressed.
He also points out that there is no evidence that Bosiljka and Darko Mladic intended to use the money for anything illegal, adding that the money was in the house before but that nobody paid any attention to it until the fourth search of the house in February 2010.
The beginning of the trial has been scheduled for May 23 before the First Municipal Court, the daily writes.
Bosiljka Mladic also faces charges of unlawful possession of weapons, which were raised against her after police searched her apartment in 2008.
When asked about Darko Mladic's motion to declare his father dead, which he launched last year, Saljic says that there were no developments and that a key document was missing.
“I have already asked police three times to issue Ratko Mladic’s certificate of residence but they keep rejecting me. And the first Municipal Court cannot act because of this,“ he said.
